🚨JUST IN: @SECGov and @CFTC issue joint interpretive guidance clarifying how federal securities laws apply to crypto, introducing a formal token taxonomy across five categories: digital commodities, digital collectibles, digital tools, stablecoins and digital securities. The agencies state that most crypto assets are not themselves securities, and clarify that activities like staking, mining, airdrops, and token wrapping are not inherently securities transactions. Under digital commodities, the SEC includes assets such as Bitcoin, Ether, Solana, and memecoins like Dogecoin and Shiba Inu as examples. The guidance also makes clear that tokenized stocks, bonds and other digital securities remain fully subject to securities laws, and that non security crypto assets may only fall under securities regulation when sold as part of an investment contract tied to profit expectations from issuer efforts.
